1) Apple has lost an antitrust lawsuit brought by the Department of Justice in a ruling that found Apple to have colluded with five major book publishers in an effort to raise e-book prices. To summarize Apple’s actions, they helped push the e-book publishing market from a “wholesale” model to an “agency” model, “where publishers set the price and Apple got a fixed percentage of the sale price.” This was all part of Apple’s attempts at undercutting Amazon, who have dominated the e-book sales, having once held 90% of the market. A hearing has been set for August 9 to discuss remedies/damages, but Apple says it is already planning an appeal.

2) Just what is happening at Hulu? After weeks of buyer speculation, with recent reports claiming a final group of four buyers (including DirecTV and Time Warner) were making moves to finalize a deal, the sale was called off entirely. The current owners, 21st Century Fox, NBCUniversal, and Disney, claimed the final offers didn’t meet their expectations and have come to a unified strategy. However, reports claim the three owners are considered bringing in more partners, with Time Warner Cable being a potential front runner. Who knows what will happen, as Hulu has been placed on and taken off the auction block before.

3) Speaking of Time Warner, they have some bigger issues at hand as their deal with CBS for retransmission ended in June, and the #1 network is asking for a huge increase in fees. The behind-the-scenes negotiations have spilled out into public threats by CBS to pull the plug, using the threat of blackouts to pressure Time Warner into giving in, claiming in a new ad blitz that Time Warner is, “threatening to hold your favorite TV shows hostage and drop CBS.” While currently nothing has been done, public outcry of blocking a free-to-broadcast channel could lead to FCC or Congressional action.

4) After recently deciding to cut ties with Warner Bros. after eight years, Legendary Pictures has come to a new distribution (and co-financing/marketing) deal with NBCUniversal. The new five-year deal will begin in 2014, following Legendary’s focus on tentpole action films which they hope to leverage with Universal’s theme parks and other cross-promotional opportunities.

rolling_stone_bomber_cover_large5) The announcement and reveal of Rolling Stone’s August issue generated massive controversy, as the cover depicts alleged Boston Marathon Bombing suspect Dzhokhar Tsarnaev and has drawn comparisons to the similar style of framing as their celebrity-laden covers. The cover and the surrounding controversy has led to multiple retailers refusing to carry the issue including Kmart, CVS, Walgreens, Rite Aid and some 7-Eleven stores. The city of Boston has responded as well, with college bookstores taking varying degrees of bans/display and mayor Thomas Menino writing to Rolling Stone’s publisher bemoaning the cover that “rewards a terrorist with celebrity treatment” rather than focus on the survivors.

6) Following last week’s news of the departure of President of Interactive Entertainment Don Mattrick, Microsoft has now detailed a organizational realignment which sees Julie Larson-Green, formerly the head of Windows, becoming the head of a new entertainment-focused group that includes all hardware development, games, music, and video. This shift comes at a crucial time for Microsoft with the release of the XBox One later this year, stuttering Surface tablet sales, and the PR snafu of the new XBox policies and their subsequent reversal.

7) Following the lead of News Corp. and Time Warner, Tribune has announced plans to separate its publishing and broadcasting divisions that will see the Tribune Publishing Co. take control of its eight newspaper holdings, while Tribune Co. will retain the local TV stations, WGN America, and stakes in Food Network, digital and real estate assets. The spin off is meant to allow both companies to retain greater focus and tailor operational strategies to better suit their mediums. Some are wondering if this means a potential selling of either new company in the future, as Tribune is not publicly traded.

8) Although Google, Microsoft, Yahoo, AOL, and other advertising network managers recently unveiled a set of voluntary “best practices” to help fight copyright infringement, the Motion Picture Association of America (MPAA) does not think it is enough. The anti-piracy plan calls for the networks to respond to copyright holder complaints with a dedicated contact person. The ad network would then lead an investigation to decide whether to contact the site, deny ad placement, or simply remove the site from the network. MPAA chairman Chris Dodd claims this only addresses a small part of the problem while placing too much burden on the rights holders… like the people in the MPAA.

GREECE-ECONOMY-MEDIA9) In a follow-up to reports a few weeks back regarding the shutting down and then reopening (a less-staffed) Greece public broadcasting station, the Greek government has now launched a new network, Greek Public Television (EDT), to take over for the Hellenic Broadcasting Corporation (ERT). ERT’s staff is now opposing the new channel, demanding a re-opening of the original broadcaster.

10) Aereo has won again at the courts, as a U.S. appeals court has declined to rehear the case brought by major broadcasters like Disney’s ABC and Comcast’s NBC. The broadcasters claim Aereo (an online television start-up that retransmits over-the-air networks) infringes copyright, but courts refused to shut down Aereo at a hearing back in April. The larger cases (CBS Broadcasting Inc et al v. AEREO Inc and WNET et al v. AEREO Inc) are still being decided, but for now, Aereo will stay on the… online.

What Are You Missing? I (Andrew Zolides, by the way) will be taking over the ‘What Are You Missing?’ Column. This will always be Chris Becker’s column, but I want to sincerely thank her for giving me the opportunity to write this terrific feature. I hope to keep up the quality you’d expect from the column, providing a slew of news from a range of media industries, including film, television, digital, video games, music, and more. If you have any questions, comments, suggestions, or news you’d like to share, I’d like to encourage you to add those to the comments. With that, onto the news!

Ten (or more) media industry news items you might have missed recently.

1) Two weeks ago was E3 (Electronics Entertainment Expo), the largest trade fair for the video game industry, and, as usual, there were several major stories coming out of the event. The biggest seemed to be Sony’s massive ‘victory’ over Microsoft in the press conferences focusing on each’s next-generation entertainment consoles available this holiday, the PlayStation 4 and XBox One, respectively. Besides undercutting Microsoft’s console by $100, Sony scored major consumer points by directly attacking Microsoft’s announced DRM policies including a required internet connection and restrictions on sharing/loaning games. Sony was clearly feeling confident, releasing this humorous video of PlayStation execs showing people the ‘complicated’ process of sharing games on their new system:

2) Yet the even bigger news took place the week following E3, as Microsoft, following an outpouring of negative consumer and media feedback and loss of pre-sales on Amazon against the PlayStation, pulled a complete 180 on the XBox One’s restrictive DRM policies. Gone are the regular on-line checks and restrictions on borrowing. While it is too early to tell if such a bold reversal will affect Microsoft’s PR woes in the long-run, they have already overtaken the PS4 on UK Amazon pre-orders.

3) Fox Searchlight Pictures has lost a lawsuit brought against them by two interns on the film Black Swan after a Federal District Court found them in violation of minimum-wage laws for not paying the production interns who were treated essentially as regular employees. The judge found the environment too similar to a regular waged position and not enough of a training/educational program to be considered unpaid. While this is a massive victory for unpaid labor in the film and media industry, many have already noted this could become a landmark decision for future cases of internship exploitation in a variety of fields.

4) Attention bachelorettes: Rupert Murdoch will soon be back on the market. Murdoch and wife Wendi Deng have filed for divorce. While Deng and the couple’s children will retain financial interest in News Corp, they do not get voting rights. In slightly less tabloid-y news, News Corp’s publishing and entertainment arms have started trading separately as a preliminary stage before the official split later this month.

5) And just to keep things going on the TMZ-front, Kanye West and Kim Kardashian are now parents of a baby girl. More interestingly, this news came just one day after West’s hotly anticipated new album, Yeezus, leaked to the internet, and three days before the album’s official release. As expected, the child of Kanye and Kim has already learned the power of synergistic corporate marketing strategies.

6) More Netflix original programming is on the way, this time from the folks over at DreamWorks Animation. The deal involves over 300 hours of new content, making it the largest in Netflix’s short history. This is part of a larger initiative from DreamWorks to branch out into the television marketplace. They are confident their TV deals (including Netflix) will generate $100m in revenue for the company.

7) Senior Senator John McCain has asked the FCC to research and consider the benefits of a la carte cable pricing. This is in line with proposals and urgings from McCain for years to offer more options to television consumers, including proposed legislation. McCain calls the current system restrictive saying in a letter to acting FCC Chair Mignon Clybrun, “This is wrong, and action should be taken.”

8) The economic and financial upheaval in Greece hit the media sector these past weeks after the government shut down public broadcaster Hellenic Broadcasting Corp. (ERT). The canceling of all state-run broadcasts and massive layoffs led to protests around the country, which eventually spread to other European broadcasters (including Britain, Spain, France, Germany, and Italy) signing a petition and speaking out. The movements proved successful, as the Greek PM Antonis Samaras offered to bring ERT back on air with a limited staff after a court reversed an early decision siding with Samaras.

9) This past week saw the annual Licensing Expo in Las Vegas, with the entire industry reporting growth of 2.5% in 2012 by bringing in approx. $110 billion. Disney has been the unchallenged king (or princess!) for years, ranking as the world’s #1 licensor generating $39.4 billion. And they are only growing, with recent purchases of Marvel and Star Wars giving them six of the top 10 franchises worldwide.

10) Our tenth story is a bit of old fashioned rivalry between… talent agencies. An extended prank by William Morris Endeavor (WME) against rival Creative Artists Agency (CAA) saw the company put up posters around Hollywood featuring “CAAN’T” that parodied CAA’s iconic white-on-red logo. The stunt even extended to t-shirts spotted in the background of the Today show and a website, caant.com. Unfortunately for us watching, Phase 2 of the ad blitz was shut-down, with the WME claiming it is “not worth it” and “The fun we had is done.”

11) To end on a somber note, celebrated actor and terrific human being James Gandolfini passed away June 19, 2013 while vacationing in Italy. Best known for his work as Tony Soprano, Gandolfini’s work extended beyond television to film, the stage, and even voice-work (see below). The outpour of tributes, honors, and reflections speaks more for how loved he was than I ever could alone. That said, I’ll leave you this week with one of my favorite memories of his work:

E3 Preview: Big Changes for the Gaming Industry http://blog.commarts.wisc.edu/2013/06/10/e3-preview-big-changes-for-the-gaming-industry/ Mon, 10 Jun 2013 13:00:33 +0000 http://blog.commarts.wisc.edu/?p=20129 E3 LogoE3, the massive videogame industry trade fair, begins this week, and with it will come a slew of announcements promising gaming will forever change. This is absolutely correct. But the most important change for videogames on the horizon is not in graphical fidelity, innovative gameplay, or (god-forbid) story-telling and quality. No, the biggest change coming to videogames is not in how we play games, but how we buy them.

Earlier this year, Sony and Microsoft announced their additions to the newest console generation, the PlayStation 4 and XBox One, respectively. Coming this holiday season, E3 will certainly be a showcase for both consoles, providing another stage for both companies to win over consumers, as well as stockholders, game developers, and industry publishers. And it is those last two that seem most at odds in Sony and Microsoft’s plans. Based on their previous announcements, let’s take a look at what we can expect from this year’s E3.

Let’s start with Sony. The biggest takeaway from the PlayStation 4 announcement, and its subsequent marketing and press materials leading up to E3, is a focus on game developers. While in-house or 1st party development teams are still a large market force (just ask Nintendo, hurting for 3rd party developers), a recent industry survey shows 53% of game developers recognize themselves as independent. This shift in the way games are being made has Sony positioning themselves to take advantage. As Andrew Groen notes in an article in Wired, “There’s a war brewing for the hearts and minds of the videogame industry’s independent developers. The weird thing is, Xbox doesn’t seem interested in fighting it.” Groen quotes independent developers like Braid‘s Jonathan Blow and Retro City Rampage‘s Brian Provinciano who found working with Microsoft to be excruciating and unnecessarily difficult, with restrictive demands and guidelines, as well as errors while publishing that have cost these developers money. Sony will be taking this message of developer-friendliness with them to E3, where they will be giving out shirts with the tagline “No hurdles, just games,” followed by the PlayStation symbol, a pixelated heart, and the word “Devs.”

Turning to Microsoft, if I had to sum up the reaction to Microsoft’s May 21 reveal of the XBox One in just one word, it would be confusion. Industry reporters used words like disaster, desperate, and uncertain. Most of this stemmed from Microsoft’s lack of clarification on crucial issues like persistent online connection, used-game functionality, and privacy concerns over the ‘always-listening’ nature of the Kinect motion-sensing camera/microphone. Perhaps Microsoft realized the situation when this past Friday it made a post on its XBox Wire titled “How Game Licensing Works on XBox One.” In the document Microsoft attempts to clarify some of these points of confusion, emphasizing how games are always installed and registered directly to your unique XBox ID (whether purchased digitally or a physical disc), how game trade-ins and reselling will be up to the publisher to decide whether to enable this functionality, and that the XBox One must be connected to the internet once every 24 hours to allow games to be played. This time the reaction was a bit worse with one reporter claiming the XBox One “just had a very bad day.”

What Microsoft is trying to do with the XBox One is apply similar digital rights management (DRM) we see used on digital-commercial platforms like Steam and the App Store to a console that still supports physical, disc-based media. By tying game purchases to individual users and accounts, they are taking the physical out of the equation, much in the same way software is already registered to individual devices (Remember, this is still Microsoft). However, this ignores the several thousands of console users who do not have dedicated internet access or simply choose to use physical copies. Consider the entire video game rental business, which is completely unsupportable by the XBox One at launch. According to the post, “Loaning or renting games won’t be available at launch, but we are exploring the possibilities with our partners.”

To be clear, Sony has not been forthright with their system’s DRM and may well take on a policy similar to Microsoft’s. Hopefully Sony will reveal that at E3. But the question remains why Microsoft would risk alienating a large portion of their users? Just as Sony is looking to appeal to game developers, Microsoft is wooing game publishers. Used games have been a scapegoat for hurting sales and profit margins, and Microsoft may appeal to publishers by giving them that control, while avoiding being the ‘bad guys’ themselves by outright banning the second-hand market.

Both Sony and Microsoft have a lot of questions to address at E3. Their answers will change the course the video game industry follows, having nothing to do with the actual games and everything to do with the economics of the market.

What Are You Missing? May 12 – May 25 http://blog.commarts.wisc.edu/2013/05/26/what-are-you-missing-may-12-may-25/ Sun, 26 May 2013 13:00:50 +0000 http://blog.commarts.wisc.edu/?p=19934 Star_Trek_Into_Darkness_351) Star Trek finally found its way to theater screens on May 16, pulling in $13.5M domestically while gearing up for a big weekend that ultimately failed to meet expectations at the box office. That’s unfortunate, I suppose, but it’s hardly what you’re here to read. If JJ Abrams is worried about the low-ish take, maybe it’s because he had far grander plans for the property. If you’re still a little confused about the CBS/Paramount/Bad Robot stand-off, this short lecture should clear things up. Look for the Star Trek flamethrower just in time for the Fourth… And what’s Star Trek without the fans? Are you fan enough? Do you know why Starfleet Command is headquartered in San Francisco? Do you speak Klingon? Do you know why the reboots don’t measure up? Are you aware of just how close we are to Warp 1 (despite the stupidity of that headline)? Kirk or Picard? (Or Pike?) (It’s Kirk, and I have a compelling argument, if you’re willing to get into it in the comments…) And, because it happened, the Empire threw down with the Doctor.

2) I was wrong about “NeXtBox,” but at least the “Xbox 720” people were wrong, too. The Xbox One is coming, and word on the street is it wants to replace everything hooked up to your TV someday, or at least before Apple can. While that’s been Microsoft’s goal for some time now, don’t expect changing the device to change the service. If you’re like me, though, it’s still primarily about the games, so don’t trade in your 360. If you’re even more like me, it’s also about committing yourself to one brand over another, even if you own multiple systems per generation. Back in the day, I was a Sony person, thanks to Kojima-san and company. (That theme still gets me riled up…) Look for a gritty, futuristic War Horse reboot for the new home entertainment system (or not). And, because it can’t be stressed enough, won’t someone please think of the archivists?!

3) A few bits of news from the world of apps caught my eye since the last post, making me wish that I owned a smartphone. (App-arently – anyone? – I’m not contributing to the elimination of the Digital Divide.) First, everyone makes apps for iOS, even you (but not me). What’s available these days? Well, you can watch ABC and be counted at the same time. Or you could tell secrets to strangers. Or you could get your carefully considered drink on. Or…you could scare yourself silly incrementally. (Narratologists, take note.) Just trying to keep up with the latest thing? This little trick might help you out. It’s not enough to have the app, though; you’ve got to use it! For example, you, too, can be a Vine auteur with the right idea and a little attention to detail. And, in case you’re keeping track of how they’re keeping track, here’s a little information about how downloads get counted. Maybe someday I’ll be a statistic …

4) Johnny Lawmaker turned his eye on a few media giants over taxes since the last post. Apple CEO Tim Cook defended his company’s accounting practices on Capitol Hill. Elsewhere, Cook played up Apple’s plans to bring some of its manufacturing back stateside, which may or may not turn out to be a long-term commitment. Google suffered a drubbing from government officials across the pond and responded, “You make the rules, not us.” (I’m paraphrasing.) And because I don’t want Microsoft to feel neglected, I’ll pass along this story, too.

5) Back in the States, Google was making litigious eyes at Microsoft over the latter’s YouTube app for Windows Phone, which prevents advertising from standing between you and a chimpanzee riding on a segway, the dapper monkey, and Muppet Show bloopers. Microsoft had a cheeky response ready, but eventually the two companies made nice. Speaking of litigation and YouTube, no luck for copyright holders looking for a class action suit against the site. Oh, and happy birthday, YouTube!

6) While governments are trying to keep media and tech companies honest, the White House is dealing with some recent bad press (too easy?), which got me thinking about who’s watching whom and how. (It’s Ozymandias, using his supercomputer.) The New Yorker launched Strongbox and made the software (developed by the late Aaron Swartz) available to other news organizations. A Congressional caucus working on issues of privacy had some questions about Google Glass, and Google had preliminary answers. Meanwhile, the CIA continues to just act natural, the Aussies experiment with web censorship, South Africa finds another peaceful use for drones, and I’m eagerly anticipating 2015. To quote Ron Swanson: “It’s a whole new meat delivery system.”

7) In the span of two weeks, it became impossible to avoid hearing about Yahoo’s intentions to acquire Tumblr, speculation ran its course, the deal became official, and the analysis  began. $1.1B is a lot of money, and I hope Yahoo gets what it thinks it’s paying for. It’s definitely getting what it knows it’s paying for.

8) Cable providers are circling Hulu. First it was Time Warner, then it was DirecTV, along with Amazon, Yahoo, Chernin Group, and Guggenheim Partners, which also happened to be advising Hulu’s owners about a possible sale as far back as mid-April. All of this reporting and speculation is incredibly premature, though, but isn’t it fun?

9) Speaking of TV, did you know there’s a renaissance on? If you’re feeling sluggish, perhaps this’ll anger up the blood: “Conformist, passive and disengaged was the traditional spectator – proactive, inquiring and interventionist is the new spectator.” Sorry… no more of that. What has been on many minds is binge-viewing. Don’t trip over the buzzwords sure to follow that discussion. “Hyperserial,” for example. And don’t forget the classics! Before there was Walter White, there were Pauline, Elaine, and Helen! Reboots all around, say I! Get ready for the PSAs, too: “When you binge, you’re not just hurting yourself.”

10) Speaking of binge viewing, as I write the final countdown has begun. Vodka rocks and toast all around! (Just like Tobias.) E-books continue to gain on real books, but (IMHO), sleek is not as sexy. Choose your poison to match the contents of your book/media shelves. Disney’s temporary insanity may have ended. The newest member of Wyld Stallyns has revealed herself. And physics continues to be awesome!

1. Happy Mother’s Day! Nielsen reports that among American moms, half have smartphones, and they love Facebook and Pinterest (Twitter, not so much). For the general US population, mobile data access is a big area of growth, while check-in apps are still mostly niche. In India, women use their phones more for talking and texting, whereas men do more web browsing.

2. “More video is uploaded to YouTube in one month than the 3 major US networks created in 60 years,” tweets a YouTube exec, with 60 hours of video uploaded every minute. Now there’s word that YouTube could add a premium subscription service. But with YouTube getting so vast, some are finding smaller competitors offer a better platform, especially for mobile sharing.

3. Ebay and Wal-Mart are looking to develop their own search engines to battle against Google’s dominance, right as a Google report insists that search engines have First Amendment rights, which would mean Google could pick and choose which content and in what order to load up for a search reply. But Google isn’t allowed to violate internet privacy the way it apparently did by hacking into Safari to track users. Microsoft might also be cheating by making Internet Explorer the only browser that will work right on the upcoming Windows RT system.

4. While the documentary has a storied history in Canada, filmmakers are having a hard time finding funding for documentaries today thanks to federal cuts. If they can dig up an extra $20,000 or so from someplace, those filmmakers can get their films into the DocuWeeks program, which will still be a conduit to Oscar nominations, over Michael Moore’s objections.

5. News out of the National Association of Theatre Owners CinemaCon convention included 20th Century Fox planning to end 35mm film distribution next year, which will have complex consequences. Plus all manner of new theatrical magic is on its way, including lasers. A few theater chains are reporting a surge in attendance right now, while the AMC chain might be looking to sell to China.

6. Overall home entertainment spending is up for the first time in awhile, though that’s mostly thanks to digital streaming and Blu-ray, and not DVDs and rental stores, of course. Blu-ray might decline too once people realize they’ll now have to sit through two government warnings before getting to the movie.

7. Microsoft has invested in the Nook, which is now worth more than Barnes & Noble itself. B&N is trying to find ways to reconcile physical and online book sales without killing off the former, as possibilities for survival and the future design of physical books are up for speculation.

8. April was a bad month for video game sales, and while EA did well last year, investors didn’t like its weak outlook for this year. EA has big development plans, though its big investment in social gaming company Playfish hasn’t paid off yet, as a CityVille competitor has flopped.

9. Rovio had a huge year in 2011, thanks of course to Angry Birds and its one billion downloads, and the company is hoping to replicate that success with the new Amazing Alex. Zynga is also trying to recapture magic with a Farmville sequel. Zynga’s acquisition of Draw Something’s company doesn’t seem to be working out, but its cloud technology is apparently to be envied.

10. 1. The Cannes Film Festival lineup is out, with heavy representation of English-language films, and the jury is also set. Meanwhile, the Tribeca Film Festival has wrapped up, with jury award and audience award winners that include a film whose Cuban actors are now seeking asylum in Miami. But Robert Levin says the big impact from Tribeca will come from its new model of digital distribution via the Tribeca Online Film Festival. And Toronto wonders, can there be too many film festivals?

2. In film production tax credit news, a British tax credit system is credited with offering a big boost to indie films, California has passed a 5-year extension, and we wait to see if Ohio deems its tax credit scheme worth renewing. We’ll also wait to see if there’s anything to the suspicion that Hollywood studios bribed the Chinese to allow them access to the Chinese film market (a deal mentioned in a previous WAYM). The SEC should also investigate to see if Russians were bribed to go see John Carter.

3. More directors are clamoring to get their films on IMAX screens, while Martin Scorsese has fallen hard for 3D, but Peter Jackson is one-upping them all by going to 48 frames per second, and even though it apparently looks crappy, Jackson says there’s no stopping it now. Some think recent indie films haven’t looked crappy enough.

4. Howard Stern’s lawsuit against Sirius XM has been dismissed, but this may not be the last we hear of it. The British will get to hear more live music, thanks to new rules that will streamline the process for small venues to book live acts. And we could soon be hearing Spotify sound just like Pandora.

5. Nintendo is struggling, so much so that they’re making video game sales overall look bad, and it might even be time for Nintendo to sell, but Nintendo thinks the Wii U and especially the 3DS will save it, with a new digital distribution strategy also offering hope for growth.

6. YouTube’s video service has turned seven years old, and for its birthday, Germany wants to give it a massive music royalty bill and demand that it better police copyrighted content, though this could mostly boil down to a negotiating tactic. A group of Hollywood studios failed in their attempt to hold an Australian internet provider responsible for piracy, but Voltage Pictures just won’t quit until they chase down every last Hurt Locker pirate. And it remains to be seen if Hollywood will go after a 92-year-old shipping bootleg DVDs to American soldiers overseas.

7. Facebook has had a drop in ad revenue this year for the first time, but it apparently doesn’t mean much in the grand scheme. After all, Facebook is nearing one billion users, over half of whom visit daily, and makes about $1.21 from each user per quarter. And yet, with 58% of its user base female, Facebook somehow hasn’t found a woman to appoint to its board of directors.

8. Apple is killing it in China with iPhone sales, and, in a fascinating story, apparently iPads can only be made in China, not due to cheap labor but to rare earth elements, which China has almost exclusive control over. Meanwhile, Microsoft is looking like the anti-Apple in the smartphone market and the consumer technology arena, but it hopes it can be all China-like in controlling Windows apps on iPads.

9. Is a Facebook “like” protected free speech? Apparently not. Is a tweet yours to own? Apparently not. Is a Tumblr with ads still a Tumblr? We’ll find out starting May 2. Will we get the internet and be able to tweet about a Tumblr we like once we’re on Mars? Maybe.

1. Warner Bros. now owns Flixster and Rotten Tomatoes, which might raise questions of bias for RT, but MPAA head Chris Dodd is more focused on Hollywood positively promoting itself, rather than individual films. This piece about Hollywood’s white people-heavy summer releases won’t help out with that, but maybe this one about Hollywood actually caring about the olds will. Other moves for Hollywood include searching Europe for remake possibilities and fighting to release more films in China. (Bonus item: Remember a few months ago when I joked about how the MPAA ratings board would explode if they had to rate A Serbian Film? From A.O. Scott’s review of the film: “A Serbian Film” is rated NC-17. The best part of this movie may be that members of the M.P.A.A. ratings board had to sit through it.”)

2. The Cannes Film Festival began Wednesday. Indiewire has a preview of what we’ll be missing, and Peter Bradshaw highlights ten notable Cannes films, including Mel Gibson’s The Beaver, which opened with a deadly thud here. Scott Roxborough says this year’s festival is about big stars and edgy auteurs, while Sharon Waxman notes that women directors are making their mark. Cannes will also feature a film by jailed Iranian director Jafar Panahi, who will be further honored in absentia with an award for courage and independence of thought.

3. The entry on ancillary film distribution always seems to start with bad news about DVDs; so why fix what isn’t broken? DVD revenue dropped 44% last year, so far in 2011 DVD and Blu-Ray sales are off 19% from last year, and Brent Lang doubts that 28-day rental delays will boost sales. On the bright side, um…aaanyway. YouTube is moving forth with its movie rental plan, which poses a marketing challenge, while Netflix is looking to expand into Latin America.

4. Microsoft bought Skype. Some analysts believe Microsoft dramatically overpaid for this acquisition and that the company’s main goal was just to keep Skype away from Facebook. Others say Microsoft has real plans for Skype, expecting that it will boost Microsoft’s standing in the communications market, especially the mobile arena, it could tie in with Kinect, and it might be Microsoft’s gateway into the smart TV business. Or this could just end up as good news for Apple.

5. Three major music industry developments this fortnight: First, Access Industries bought Warner Music for $3.3 billion, which could also open the way for a merger with EMI, though that will be a highly competitive bidding process with regulatory issues. Second, Google has launched its cloud-based music service locker, without the support of record labels, which means it’s basically a remote hard drive for your own music, not a purchasing service, making it positive news for the future of cloud computing but keeping Google and Amazon well behind Apple. And third, dead piracy outlet LimeWire has settled with 13 music labels for $105 million in copyright damages (note: artists don’t get a cent of that), but during the trial, LimeWire’s lawyers tried to stress that label mismanagement and poor executive stewardship was ultimately at fault for the music industry’s troubles, not piracy.

6. A “Do not track” bill that allows consumers to opt out of online info tracking has been introduced in the Senate; media scholar Jeff Jarvis doesn’t think such a bill is necessary, while Google and Facebook argue that such bills can be economically threatening. Amazon is using the economic threat of sales tax imposition to cut ties with more states, and another online business regulation story to keep an eye on is the internet censorship bill. (Random extra that might make you feel old: “All your base has belonged to us” is ten years old.)

7. If you follow any British people on Twitter, you likely saw a #superinjunction tweet or two over the past few weeks. It’s part of a right juicy scandal, as only the Brits can do best, involving sex, celebrities, footballers, gossip, privacy, and gag orders, all writ even larger thanks to social media, especially Twitter, which saw its best UK day ever last week thanks to the circulation of rumors and jokes. Twitter itself is trying to stay out of it and UK gag laws might not even apply to the US company. (Hmm, I wonder if they’d apply to WAYM.)

8. Busy days for Facebook, from internal arguments over prospects in China, to more Congressional questioning over Facebook’s security and privacy issues, to consumer advocate concerns over photo-tagging of brands, to a little matter of Facebook losing face after getting caught conducting a surreptitious smear campaign against Google and trying to evade accountability for it, though some say that the point Facebook was trying to get across about Google’s privacy issues is at least a valid one (you can find an extensive discussion of those issues here).

9. A few items this fortnight showcase major challenges faced by news media outlets: Google lost a precedent-setting appeal in Brussels over links to Belgian newspapers, Facebook is closing in on Google’s news traffic driver dominance, debates about unpaid online contributors and how we judge journalistic value continue to rage, the New York Times website is at a break-even point post-paywall, and a new New Yorker iPad app may represent the beginning of the end of print. Finally, the 2011 National Magazine Award Winners have been announced, and I plan to read the winning articles online, with Instapaper allowing me to save them to read later. Sorry, paper.

I plan to file “Report From…” Antenna posts on Sundays (as long as climate change doesn’t kill the UK’s wifi first) that cover my new experiences with watching and teaching British television. I’m also working on a new research project comparing and contrasting British and US industry practices and programming, so I hope to kick around a few preliminary ideas in these posts, and I especially hope that numerous British and Anglophile Antenna readers offer their thoughts and answers to the (occasionally dumb) questions I’ll raise. What Are You Missing? A woman could possibly head up the MPAA soon, but women still hold only a small minority of top Hollywood filmmaking jobs. Things are perhaps changing for over-40 actresses, but Melissa Leo deeming it necessary to generate her own Oscar campaign might indicate differently (even if it’s a bad move). Also fighting for respect is the British film industry, so I’ll make up for mocking it last time by linking to an article considering that the British Academy Film Awards (whose ceremony is today) are better than the Oscars.

2. Lionsgate will test out a new low-budget release strategy, and a pair of theater chains plan independent releases of their own, which David Poland hopes is the good news for indie film it seems. Ted Hope and Cole Abaius are optimistic about the future of modest-budget indies, while Paul Thomas Anderson is just going straight to billionaires, who will be especially handy once all the state tax breaks dry up.

3. Blockbuster is seeking a buyer, which could put Carl Icahn back in the regular WAYM rotation. In related news, studio DVD money is plunging, online movie downloads are outpacing TV sales, Apple is still dominant in those downloads (though Walmart is inching closer), and Netflix users are #1 in loyalty.

4. At a time when nearly a quarter of global internet traffic involves illegal downloads, the White House is working up new digital copyright laws. I hope Obama’s better at this than the MPAA. Of course, a notable number of users say they don’t want to pirate, but the nonsense just drives them to it. One study found that it’s not music being pirated the most or even Hollywood movies. Of course, it’s porn, which has prompted porn industry lawsuits against sites like RedTube, but RedTube thus far has finished on top (no pun regretted).

5. Google caught Microsoft stealing its search results for Bing’s use by launching a sting operation that would make Henry Gondorff proud (if you don’t know who that is, you should google it, or you can bing it and probably get the same results). But some see Microsoft’s theft as smart, even as Google turned it into a PR coup. Flickr had a potential PR disaster with news it had accidentally deleted a user’s 3,400 photos, but it managed to recover all of them. The BBC had to be embarrassed when, after it scheduled 172 websites for deletion claiming it was necessary due to budget cuts, a clever netizen archived them all for only $3.99.

6. Many are using iPads to timeshift reading of online content throughout the day. Many fewer are reading the new iPad newspaper The Daily, which is most notable thus far for being buggy and not Flipboard. Magazines for iPad have mostly been a bust, though there’s hope for the new Sports Illustrated approach, which Apple could still screw up by getting all Appley and proprietary, as it has with e-book sales.

7. Twitter’s been busy lately, what with the Super Bowl and Egypt, plus there are rumors about charging users and a possible multi-billion dollar takeover. Facebook is one of Twitter’s potential suitors, and while Facebook has also been busy with Egypt, it has still managed to trademark “Face” in Europe and pick up the prostitute slack from Craigslist, despite only just turning seven years old.

8. Activision has made major cutbacks, the most publicly notable result being that Guitar Hero is dead (long live Guitar Hero!). Analysts are trying to make sense of Guitar Hero’s demise, blaming greed and the transitory nature of novelty, but the upside is we now have an awesome infographic about the life and death of Guitar Hero. In light of Guitar Hero’s fade, Rus McLaughlin fears for the future of Call of Duty.

9. Citigroup has taken over EMI, which Bobbie Johnson sees as just more music industry cluelessness; Ticketmaster has some new competition but also a new European acquisition; Spotify’s coming to the US, no really, it is, any time now, really soon; Pandora is going public; Warner and Sony Music are skidding; and the car cassette deck is dead (long live the car cassette deck!).
