1. Sundance is spreading its influence further, opening a new indie film theater in Los Angeles and enabling online distribution of a set of Sundance Institute films. Over in China, a film festival has been suppressed, as the Beijing Independent Film Festival was canceled due to political pressure. And Nigeria’s burgeoning film industry, Nollywood by nickname, is fighting to overcome challenges to compete with Hollywood films.

2. The summer movie box office was down from last year, with 100 million fewer tickets sold (though Fandango sold more tickets than ever in its history), and the US is dragging down Canada with it. The Avengers and Magic Mike were among the handful of winners.

3. Amazon has a big announcement coming on Thursday, and while most speculate it will be about a new Kindle Fire, Ryan Lawler wonders if it will involve support for Hollywood’s UltraViolet service. David Pogue thinks better legal online services will help limit piracy of Hollywood movies, and the Weinstein Co. is trying a creative approach with the Kirsten Dunst film Bachelorette. Incidentally, we’ve reached the 100th anniversary of film’s copyright designation.

4. While Amazon is touting all of its Kindle achievements, sales of Barnes and Noble’s Nook are falling, and the device is suffering from multiple problems. B&N will still launch the Nook in the UK soon, though it will first be available not in a bookstore but at the home goods retail store John Lewis. Overall, B&N revenue is up.

5. Streaming music revenue is expected to far outpace downloads in the coming months. Spotify has seen a slight dip in usage recently, while Pandora is having revenue problems, leading it to try and lower musicians’ royalty payments, and Spotify may be thinking the same. But rest assured, at least RIAA executives are raking in money.

6. After 24 years of publication, the magazine Nintendo Power is shutting down, and after 18 years of game development, Europe’s Studio Liverpool is closing up shop. 5-year-old social games company Zynga isn’t going to dry up anytime soon, but it is struggling right now. And even the venerable Angry Birds franchise is getting a challenge from free-to-play games.

7. Facebook’s stock plunge continues, with 50% of its initial value gone and even more likely going, but some are still recommending it as a buy, and the service itself certainly isn’t struggling, as it trails only YouTube as a popular video destination and processes 2.5 billion pieces of content each day. Plus, the company’s getting a sweet new campus designed by Frank Gehry.

8. Twitter isn’t winning many fans with its new API rules, which limit how services like Tumblr can interact with its users. Twitter will also no longer display the client source of tweets. Many analysts see these changes as indicative of Twitter at a crossroads, and new relationships with entities like NBC seem to hint that it is leaning toward becoming more of a media company, rather than just a social media utility. And apparently, it could get hired in a movie studio casting department if it wants.

9. Meet the people who scrub the internet of its worst content. Find out why people write comments on internet porn. Learn everything you need to know about the internet’s obsession with cat videos. Get annoyed by the prevalence of fake internet book reviews.

1. The fight over the R rating given to the Weinstein Co.’s Bully is intensifying, and as many rally around the film, it’s looking like it will be released without a rating. Getting slightly less attention, as any non-shirtlessness story tied to Matthew McConaughey will, is the NC-17 rating given to Killer Joe for violence and sexuality. Meanwhile, Lionsgate UK (ding!) trimmed seven seconds from The Hunger Games to drop the restricted age limit from 15 to 12.

2. Iran cancelled a planned celebration of Oscar-winning director Asghar Farhadi, with no indication why, but Farhadi still says he loves Iran and will never leave. Well, except maybe to make films, and he thought Paris looked like a good place for that. He might notice while he’s there how France has celebrated Oscar-winning actor Jean Dujardin.

3. The Guardian’s David Cox says Hollywood is courting older viewers now who don’t want special effects-laden blockbusters (ah, so that’s why John Carter bombed…or did it?). But theaters are still courting youth and their ever-present mobile phones, and Hollywood is offering any number of ways to watch movies on handheld devices, including wristwatches. (Somehow I don’t think a movie-viewing wristwatch is something I should get grandpa for his birthday this year.)

4. Wal-mart announced its “disc to digital” service for Ultraviolet, which could be make-or-break for UltraViolet, but Peter Kafka thinks it will be a tough sell given the various restrictions and inconveniences that come with it. But as a recent ruling against DVD-ripping technology Kaleidescape indicates, restrictions and inconveniences are the rule right now.

5. Nielsen stats say over half of US households have current gaming consoles in the home and gaming on mobile and tablet platforms is on the rise, and it looks like we’ll also have a new Xbox as an option by 2013. If we end up unhappy with our Xbox games, apparently we can sue the FTC over them, as gamers frustrated with the ending of Mass Effect 3 have done, though the game’s executive producer defends the ending and other perceived failings of the game.

6. More interesting stats courtesy of Nielsen: More women than men are blogging, and just over half of bloggers are parents with under-18 kids in the house. That might be related to why so many are impatient with slow-loading websites. But just imagine how tough it is to be a blogger in one of the Internet Enemies countries.

7. We’re not quite sure yet if tablets are hurting e-reader sales, and we’re not quite sure yet about how Kindle Singles are selling or how much money authors can make from them exactly, and we’re not quite sure yet if the Department of Justice has a case to make against publishers for colluding with Apple, and against Amazon, on e-books prices or even what e-books should cost. But we’re getting there.

8. A UK college student is being extradited to the US to face copyright infringement charges for hosting links to pirated media on his website. This is leading to a larger conversation in the UK over extradition laws, reaching all the way to the highest offices in each land.

9. Yahoo is suing Facebook over patents. Facebook says it’s disappointed and plans to fight back, though some expect Facebook to eventually settle or outright buy some of Yahoo’s patents.

1. Facebook’s Like button is a year old, and while a Dislike button apparently won’t be coming around, you can look for Send and also Deals. Facebook content you used to see might not be there anymore due to bogus DCMA claims (and possibly homophobia). Don’t bother looking for your old Friendster content, because after May 31 it’s gone forever. And there are scary rumors that Twitter will make TweetDeck go away forever (please don’t take my TweetDeck away!).

2. Amazon’s cloud went poof last week (but is fixed now), and apparently we can all learn a lot from this. But some might be scared away from cloud services because of it, especially once they hear that some data lost during the outage may not be recoverable. In other weboopsies, Gawker’s redesign fail shows how mistakes can kill traffic, and the new owners of Delicious hope to rectify the old owners’ mistakes.

3. According to a Freedom House report, as more people across the globe use the internet, more governments are clamping down on internet freedom, none worse so than Iran (sorry Burma, you came up just short), which has inspired Anonymous to strike. The US is the Wild West by comparison (only Estonia ranks as freer in the report), though broadband caps are arriving this week, while within the European Union, net neutrality legislation has been nixed.

4. Netflix is really rolling, yet it isn’t standing pat, as the company plans more original programs, family plans with separate profiles, and international launches. It can also count on rising content costs, plus many new competitors, as Wal-Mart, YouTube, Dish, and perhaps even Spotify (coming to America soon!) plan Netflix alternatives.

5. Though consumers are still clinging to DVDs in significant number, they’re simply not embracing Blu-ray, and Netflix sounds pretty happy to dump discs altogether whenever we’re ready (right as competitors might find shipping them to be cheaper). Search engine stats from Google show that users seek out Netflix info far more than DVD info, and Netflix Instant may be putting a crimp in illicit file sharing activities too. Meanwhile, China is shredding DVDs, though just as a piracy PR stunt.

6. The RIAA music shipment figures for 2010 are in, and both physical and mobile units plunged relative to 2009. But there was at least some nice sales news for independents and vinyl in the form of Record Store Day, plus people are still interested in investing in the music biz, and iTunes continues to post impressive sales figures. Amazon is trying to better compete with iTunes by lowering download prices, but Apple’s already looking to move on to cloud streaming and has the edge over Amazon there too due to label deals, such as with Warner Music.

7. You surely heard about the Sony PlayStation Network debacle (which will start to be resolved this week), but you may not have heard that with Wii console sales way down, Nintendo will unveil Wii’s successor at E3 in June, with retail release schedule for 2012. Also in June, Redbox will launch game rentals. Finally, the video game industry does better than anyone else at keeping minors from buying mature content, though it seems that a young gamer’s best odds are at Wal-Mart. (Not that I encourage the underaged to buy mature content. Just passing out news here, folks.)

8. The premium video-on-demand experiment has begun on DirecTV with Adam Sandler’s Just Go With It, and now Comcast wants in on the action, but it might be tough to determine how many consumers actually demand anything in the end. One thing we can all agree on is that there’s much disagreement over how this will affect the industry. In addition to theater owners, many directors and producers are against premium VOD, fearing the death of theatrical exhibition and much lost revenue. Meanwhile, new MPAA head Chris Dodd is just speaking vaguely about building bridges.

9. Some tough indie film news, as a drop in foreign pre-sales hurts, and the future of specialty theater chain Landmark Theaters is in question, with Mark Cuban putting it up for sale. But Harvey Weinstein at least foresees a very profitable 2011, other indie producers and distributors insist that smart choices and a solid libraries will carry the independent film business along, and streaming sites Fandor and Snagfilms believe that Netflix’s focus on television content boosts their fortunes for reaching indie film audiences.

1. There was a ton of Netflix-related news the past few weeks, the biggest being the House of Cards deal, which you can catch up on via the @N4TVM link below. Otherwise (*deep breath*): Netflix controls about 60% of the market for digital movies; digital distribution is killing DVDs, and Netflix appears to be piling on with its iPad app; consumers seem to prefer streaming rentals over download sales; Amazon is the new upstart; Facebook is also dipping a toe into this arena with some Warner Bros. rentals, but Netflix isn’t scared by this, nor should it be, really, plus Netflix is even testing integration with Facebook accounts; Netflix has been hit with a class-action lawsuit involving customer privacy; Netflix has a deal with Nintendo for the 3DS; Hollywood sees Netflix largely as a disruptor and may try to destroy it (hmm…that sounds familiar to film industry historians), which makes it even more enticing that Netflix’s streaming contracts with the studios expire soon, including the unique deal with Starz (and also just as Netflix’s streaming costs are declining); and finally, maybe UltraViolet will be the long-term studio answer to Netflix’s challenge, but in the short-term, Andrew Wallenstein recommends a premium VOD war. Last-minute bonus link: The Economist lays out all the threats to Hollywood’s home-entertainment business.

2. The major Hollywood studios have had mixed profitability results over the past year (they apparently need to study our brains more). Studio profits won’t be helped by state plans to heavily curb Hollywood tax credits, though some Californians are defending the economic value of theirs. AOL is trying to stay relevant by courting Hollywood, and if Huffington Post bloggers don’t like working for free for AOL, they can at least be glad they’re not working for the Weinstein brothers. (Special bonus link: Box Office Magazine has opened up its vast archives for free access.)

3. Christopher Dodd has been named MPAA chairman, so now he gets to tackle (ignore) the complaints (proof) that the MPAA ratings board is biased against independent producers. Beyond the US, there are a number of films dealing with content objections, including A Serbian Film (*MPAA ratings board explodes*). The British will soon get to see (allegedly) riskier films now that Robert Redford is launching a mini-Sundance festival in London. Sundance and Tribeca are also both looking online for distribution possibilities, plus there’s the new website Fandor, a Netflix for indies trying to foster an online social community around independent film (MPAA ratings board members need not apply).

4. You probably heard about the House voting to defund NPR, but a closer look reveals that the bill doesn’t technically defund NPR per se (NPR, the parent organization, doesn’t get direct federal funding). Instead, the bill forbids NPR’s member stations, such as Missouri’s KCRU, from spending their federal funds on NPR’s national programming and dues. But the bill is unlikely to get through the Senate anyway, so this largely boils down to politicians playing to their bases (with the pointlessness of the endeavor mocked effectively by Rep. Anthony Weiner). But while the vote indeed fell heavily along party lines, seven Republicans did vote against it, and another, Rep. Justin Amash, just voted “present” as a way to express his concern that the bill doesn’t actually reduce federal spending. Plus – hold onto your hats, hipsters – Sen. Saxby Chambliss was heard defending NPR (though he said it on an NPR station, so perhaps he was just being kind to his hosts). If you need a quick primer on some of the basic arguments surrounding NPR station funding: on one side, Sen. Jim DeMint explains why he thinks public broadcasting should go private, and Rick Green argues the government shouldn’t give handouts to the news media; on the other side, journalists Leonard Downie Jr. and Robert G. Kaiser argue that NPR deserves support for filling a crucial gap in local news coverage, Rep. Jim Moran says federal funding is essential for the survival of NPR’s stations, and community activist Sally Kohn uses a dog as a visual aid to clarify just how much of a “budget saver” completely defunding NPR stations would be.

5. Spotify now has more subscribers than any paid music service in the world, and it’s staffing up for its US launch, which, as you know from reading the previous 10 or 20 WAYM posts, is going to happen any day now. Meanwhile, Apple is working on its cloud music service, and it may also soon offer unlimited downloads of purchased music on iTunes, while the digital music service Mog wants to get into your car (it’s “the Holy Grail,” says Mog’s founder, which makes me look at my little Ford Focus in a whole new way).

6. Ina Fried looks back on how Rovio managed to drum up $42 million in its first crack at venture funding, while the WSJ and ReadWriteWeb look ahead to the future for Rovio’s Angry Birds, and Rovio’s CEO predicts that console games are doomed by the dominance of social and mobile gaming. (By the way, did you get the Angry Birds St. Paddy’s Day update? More pigs than ever.) But Xbox just had a great sales month thanks to strong Kinect sales, Nintendo is pushing 3-D heavily, and PlayStation is looking to the cloud.

7. Google is drawing fire for favoring the company’s own sites with its search engine, discriminating against the blind with Google apps, and getting excessively favorable treatment in Britain, but it’s on the other side of accusations that an online video technology it backs has been unfairly smothered by tech rivals. Within Google’s corporate umbrella, YouTube is expanding its staff, and it has acquired one service that makes your videos better and another that makes better videos.

8. The Internet is up for a Nobel Peace Prize (woo The Internet!…wait, there are 241 nominations? Is LOLcats nominated too?). But don’t look for The Internet to win any presidential medals, as it hasn’t helped The American Economy grow as much as one would expect. You better not tell The Nobel Committee about the new .XXX domain designated for Porn Sites (or maybe that would help The Internet’s chances?). And you’d best not tell Anonymous if The Internet, or also-nominated Wikileaks, doesn’t win a Nobel, since The Nobel Committee is just about the only entity not under its attack yet.

9. Twitter is now five years old; Twitter Blog has some celebratory stats, and Funny or Die has a Ken Burns-style retrospective (with a bit of NSFW language). Five is the cute stage, but it’s also when kids have to learn the value of sharing, and Twitter is taking some chances with not playing nice with third-party apps, even as users show a preference for them. Perhaps a time-out is called for so Twitter can think about what it’s done.

What Are You Missing? 1. The Weinstein Co. has made a deal with Google for YouTube rentals and bought into Starz Media for DVD and digital distribution, which is also a way to get some Netflix money. Studio executives have a complicated relationship with Netflix, and Redbox is finally starting to feel its competitive pressure. As far as disc sales go, Blu-ray is helping to offset DVD’s decline, but they could both be replaced by something called UltraViolet someday.

2. Anne Thompson tells us everything we need to know about the 2010 box office. And whether you need to know it or not, here are a slew of movie awards and nominations announced in this past fortnight: Producers Guild, Writers Guild, Directors Guild, Art Directors Guild, American Society of Cinematographers, Visual Effects Society, BAFTA, Scientific and Technical Oscars, Broadcast Film Critics Association, and last and boldly least, the Razzie Worst Picture shortlist.

3. Independent film is increasingly going the video-on-demand route, and both Sundance and Slamdance will have films available on VOD, while black-themed films are trying to take advantage of a growing film festival circuit. Edward Jay Epstein sees indie cinema as an endangered species at this point, while Ted Hope is filled with, um, hope for the next decade, though he is frustrated that there still aren’t more indies in the National Film Registry (most recent entries, if you missed them).

4. Pingdom has a bunch of stats about internet use in 2010, and Reddit in particular had a great year, while China is touting how much it censored the internet last year. Kudos! The US trade deficit with China is made notably worse by the iPhone, but when your company is worth $300 billion, your App Store has reached 10 billion downloads, and your Mac App Store is an instant success, you can probably still sleep at night pretty well.

5. Google’s acquisition of eBook Technologies enhances the company’s digital book distribution plans, though Google now has to contend with the European Commission’s concerns. But that’s nowhere near the trouble Borders is dealing with right now, including possibly being cut off by publishers. The trouble seems to stem from Borders being a digital step behind, whereas Barnes & Noble has benefited from sales of its Nook e-reader. (Totally not related to digital distribution but a must-read print industry story that I wanted to fit in: how the New Yorker Saddam Hussein statue article was financed by nonprofit sources.)

6. Hypebot has an infographic breaking down some 2010 demographics of Facebook and Twitter users. Most of the Facebook news this fortnight was about money: a Goldman Sachs investment, plans for an IPO, predicted 2011 profits of $1 billion, and market power evaluations.  Most of the Twitter news was about tweeting: reading the US mood through tweets, the rise of hashtagging, thriving regional slang in tweets, the Ashton Kutcher bump, a UK crackdown on deceptive paid tweets, and the Wikileaks subpoena.

7. MySpace is crumbling, with overseas shutdowns, mass layoffs, and angry ex-employees. Dan Frommer thinks this opens up a great opportunity for Tumblr, while Google appears to have given up on social media. But Douglas Rushkoff worries that corporate marketing could ruin all of social media.

8. 2010 was a very down year for album sales, both in the US and the UK, but it’s been a pretty good past ten years for iTunes, and TorrentFreak claims more music than ever before is being sold, if not on CD any longer. Spotify’s general manager thinks the URL will be the music format of the future, and Pandora wants to get into your car. Too bad Spotify isn’t coming to the US…wait, yes it is…well anyway, should it?

9. Video game sales in 2010 were down 5% and total spending on gaming content was flat compared to last year, but GameStop had a great Christmas (to the consternation of Joystiq commenters). For console sales, Microsoft’s Xbox was king in 2010 thanks to Kinect, but Nintendo wants to remind us that the DS is the best-selling console to date in the US. Some things to keep an eye on in 2011: DC Universe Online, digital sales, and Sony’s PS3 hacker suit.

10.
